HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.A. No. 794 of 2018 JUDGMENT:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ appeal is preferred against the order dated 26.04.2018 in W.P.No. 13432 of 2018 passed by the learned Single Judge of this Court, whereby the writ petition filed by the appellant - petitioner was disposed of directing the respondents to conclude enquiry within a period of four weeks from the date of receipt of a copy of the order since the appellant was suspended in January, 2018. It is specifically directed that if the enquiry is not concluded within the time stipulated, the respondents shall reinstate the appellant into service and the same will be subject to enquiry.

It is an admitted fact that four weeks, as per the impugned order, have already been passed by 26.05.2018, however till date, enquiry has not been completed. Hence, without commenting on the merits of the case, we hereby direct the respondents to reinstate the appellant into service forthwith and his reinstatement shall be subject to departmental enquiry.

With the above direction, the writ appeal is disposed of. No order as to costs.

SKK,J & AKS,J WA_794_2018 As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
