THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL REVISION CASE No.1730 OF 2006 ORDER:

This revision is filed aggrieved by the order dated 19.07.2006 passed in Criminal Appeal No.47 of 2005 by the Sessions Judge, Warangal.

Heard learned Additional Public Prosecutor for the 2nd respondent-State and perused the record.

There is no representation on behalf of the petitioner.

The Court of Sessions by way of order dated 19.07.2006 was pleased to allow Criminal Appeal No.47 of 2005 and set aside the conviction and sentence passed against the accused by IV Additional Judicial First Class Magistrate, Warangal in C.C.No.184 of 2003 dated 19.04.2005 for the offence punishable under Section 138 of the Negotiable Instruments Act. As seen from the material evidence on record, the Court of Session has examined in detail the evidence of P.Ws.1 and 2 and also Exs.P.1 to P.10 and Exs.D1 to D7 and passed a detailed order. The findings of the Court of sessions are based on material evidence on record.

Under these circumstances, there is nothing to take a different view. There is no miscarriage of justice. The Criminal Revision Case is devoid of merit and it is liable to be dismissed. In the result, the Criminal Revision Case is dismissed. The Miscellaneous Petitions, if any, pending shall stand closed.
