THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.6494 of 2015 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This writ petition is filed seeking declaration by way of Mandamus to declare the action of the respondents in stopping the facility of downloading the way bills and other statutory forms from their website, to the petitioner on the ground of tax default as per the website endorsement, dated 20.02.2015, of the Commercial Taxes Department, as illegal and arbitrary.

Today when the matter is taken up for hearing, learned Special Standing Counsel for Commercial Taxes appearing for the respondents submitted that the facility of downloading the way bills and other statutory forms from the website is being stopped to the petitioner, as much as tax to a tune of Rs.27,000/- is due from him. It appears that no notice was issued to the petitioner for recovery of arrears of tax. Learned counsel appearing for the respondents, however, submitted that the respondents are taking steps to restore the facility of downloading the way bills and other statutory forms from their website, to the petitioner.

In view of the above-mentioned submissions of the learned counsel for the respondents, this writ petition is disposed of directing the respondents to restore the facility of downloading the way bills and other statutory forms from their website, to the petitioner. However, it is made clear that this order does not preclude the respondents from initiating appropriate proceedings against the petitioner for recovery of tax arrears, if any. As a sequel, miscellaneous petitions, if any, pending shall stand closed. No order as to costs.
