THE HON'BLE SRI JUSTICE T.AMARNATH GOUD W.P.NO.22850 OF 2006 ORDER:

This writ petition is filed seeking to declare the action of the first respondents for not considering the request of the petitioners for assigning the lands in an extent of 1 1⁄2 acres each in Sy.No.1327 of Kolanur village, Odela Mandal, Karimnagar District as arbitrary, illegal and violative of the directions of this Court in WPMP.No.15669 of 2004 in W.P.No.98 of 1994 dated 23-02-2005, 2.

The petitioners 1 and 2 are the petitioner in the earlier W.P.No.98 of 1004 and third petitioner is the son of petitioner No.3. The petitioners belong to scheduled caste and landless poor persons and they sought for granting pattas in their favour. 3.

In pursuance of the orders passed by this Court in earlier round of litigation, the respondents have considered and recommended their case for implementation of the orders passed by this Court, which is evident from the proceedings of the second respondent dated 14-07-2006 and respondent No.3 dated 23-7-2005. The petitioners also issued a legal notice dated 23-10-2006, requesting the revenue authorities to grant D_Form Pattas as per the directions of this Court in Review W.P.M.P No.166659 of 2004 in W.P.No.98 of 1994, dated 23-2-2005. Since no action has been taken finally in the matter, this writ petition has been filed.

Without expressing any opinion on merits, to meet the ends of justice, this Court deems it appropriate to direct the respondents to

consider the case of the petitioners 1 and 2, who are petitioners in the earlier round of litigation and pass orders in accordance with law, within a period of two months from the date of receipt of a copy of this order and since the third petitioner herein is not a party to the earlier round of litigation, though he claimed to be the son of Mr.Lingiah, petitioner No.3 in earlier writ petition, liberty is given to him to file a representation along with documentary evidence in support of his claim before the respondents and the same shall also be considered within a period of three months from the date of receipt of such representation of the third petitioner.

With the above direction, the writ petition is accordingly disposed of. No order as to costs. As sequel, the miscellaneous petitions pending if any shall stand closed.
