THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.20388 of 2004 Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) Learned Government Pleader appearing in this matter submits that no counter is required to be filed. However, he submits that no complaint has been made to the Municipal Corporation, which has to act in this matter.
Under the circumstances, it will be open for the petitioner to make a complaint to the Municipal Corporation for taking action. Such complaint must be in writing. If complaint is made within a period of fortnight from the date of receipt of a copy of this order, action shall be taken by the Municipal Corporation within eight weeks from the date of communication of this order. Interim order passed by this Court in this matter will continue till the expiry of the time given by this Court to make such complaint. If such complaint is made, interim order to continue till the disposal of the same in terms of this order. It is made clear that if no complaint is made within the time stipulated above, interim order will lose its effect automatically. The Writ Petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed. No costs.
