HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.3303 of 2018 ORDER:

Heard both sides.

It is stated that pursuant to the order of this Court, dated 15.06.2018, to pay 50% of the decretal amount under execution within five weeks therefrom compliance is stated made. Leave about the calculation differences that to be ascertained by the Executing Court, where the matter is pending under execution. Undisputedly, against the main order under execution if at all any appeal pending, there is no stay in force. As once there is a stay, the question of proceeding further with execution does not arise including to maintain the revision against the Executing Court's order. There is nothing to interfere with the Executing Court's order, but for to grant eight (8) weeks to pay the balance. Failing which, the lower Court can proceed further with the execution.

Accordingly, the civil revision petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No costs.
