ORAL ORDER:

Petitioner is an unemployee. He claims to possess Bachelor's Degree with B.Ed (Special Education) and eligible to be appointed as Special Teacher. In this writ petition, petitioner challenges G.O.Ms.No.

Finance (SMPC-I) Department, dated 21.12.2012, wherein while creating 1476 posts of School Assistants (Special Teachers) under Union Government Sponsored Scheme for Inclusive Education for Disabled at Secondary level, no post is earmarked to teach mentally retard and learning disabilities persons. 2.

In the counter affidavit filed on behalf of second respondent-Government deposed by Mr P. David Raju, it is averred that on the same issue PIL No.52 of 2013 was filed and this Court by order dated 18.11.2013 directed the State Government to consider the proposal of the petitioner therein for giving equal treatment to specialized teachers for imparting education to the mentally retard students and to amend G.O.Ms No. 341 dated 21.12.2012. As a consequence, G.O.Ms. No. 341 dated 21.12.2012 was amended re-distributing 860 posts of School Assistants (Special Teachers) in the ratio of 1 : 1 : 1 i.e., hearing impaired, visual impaired and mentally retarded vide G.O.Ms No.39 Finance (HRI) Department dated 7.4.2015. 3.

Having regard to the steps taken by the Government to redistribute the posts sanctioned in the above manner, counsel for petitioner submits that petitioner is satisfied that his grievance is answered and that no further orders are required to be passed in the writ petition. 4.

Having regard to the above submission, writ petition is disposed of as infructuous. No costs.

Consequently, miscellaneous petitions, if any pending, are closed.
