HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.10921 of 2015 ORDER:
This Writ Petition is filed seeking to issue a writ of Mandamus to declare the action of the 3rd and 4th respondents in not granting permission to the members of the petitioner-society for catching the fish in Chinthalacheruvu and Ooracheruvu located in Chandaram Village, Luxettipet, Adilabad District, as illegal and arbitrary and consequently direct the respondents to accord necessary permission to the petitioner-society to catch the fish.
Having heard the learned counsel on either side and perused the material available on record, this Court is of the view that this Court, at this stage, cannot give direction to the respondents to accord permission to the members of the petitioner-society for catching the fish. For catching the fish, the members should be recognized as per the provisions and rules of the Fisheries Department. Anyhow, the petitioners are at liberty to give representation to the respondents herein, more particularly to the Respondents 2 and 3, informing them about the grievance of the members of the petitioner-society, including the newly added members of the petitioner-society. On such representation, the Respondents 2 and 3 are directed to consider the representation in a proper perspective and pass appropriate orders in accordance with law.
The Writ Petition is accordingly disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, in the Writ Petition are closed.
