THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.22357 of 2019 ORDER:

In the light of the order proposed to be passed by this Court without going into the merits of the matter, there is no necessity to put the unofficial respondent-respondent No.5 on notice or afford him an opportunity of hearing.

The present writ petition is filed seeking a direction to respondent No.4 not to interfere in the civil dispute pending between the petitioners and respondent No.5.

From a perusal of the material placed on record, it is evident that the petitioners herein are the owners of certain extent of agricultural land and in respect of which, it appears that there is a civil dispute between the petitioners and respondent No.5 herein.

It is averred in the affidavit filed in support of the writ petition that respondent No.4 is interfering into the civil dispute between the petitioners and respondent No.5 and therefore, they sought for a direction to respondent No.4 not to interfere in such civil dispute. It is also stated by the petitioners that with regard to such interference by respondent No.4, petitioners had made representation dated 10.09.2019 to respondent No.3, which was received by the office of respondent No.3 on 12.09.2019.

Since a representation has already been made to respondent No.3 brining out the interference that is being made by respondent No.4 in a civil dispute between the petitioners and respondent No.5, the said respondent is hereby directed to consider and issue necessary instructions to the concerned and in particular respondent No.4 not to interfere in the civil dispute between the petitioners and respondent No.5 or not to call

the petitioners to the police station unless their presence is required in any other offence. It is also made clear that respondent No.4 shall not interfere with the life and liberty of the petitioners except in accordance with law.

The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs. ____________________ JUSTI CE T.VI NOD KUMAR Date:15.10.2019 GJ
