THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6193 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.78 of 2022 on the file of Station House Officer, Manoharabad Police Station, Medak District registered for the offences punishable under Sections 366(A) and 376(2)(n) of Indian Penal Code and Section 5(I) & 6 of POCSO Act.

Heard learned counsel for the petitioner/Accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The facts of the case are that, the petitioner is alleged to have closely moved with the victim girl and also participated in a sexual intercourse over a period of time. On 17.04.2022 the victim girl went to Medchel and met the petitioner herein. Both of them went to Palasa town of Andhra Pradesh and stayed there till 26.04.2022, on which date the petitioner was apprehended by the police.

Learned counsel for the petitioner submits that as seen from the remand report the petitioner and the victim girl were in love and the victim girl is aged around 17 years and 8 months. However, learned Assistant Public Prosecutor submits that the investigation is complete and charge sheet is already filed. 5.
In the said circumstances, when the investigation is complete and charge sheet is filed, the petitioner/Accused can be granted the relief of regular bail subject to conditions. 6.
Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions:
i) The petitioner/Accused shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to the satisfaction of Prl.Judicial First Class Magistrate, Gajwel, Medak District.
ii) The petitioner/Accused shall appear before the trial Court on every date of hearing without fail.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
