Feeling aggrieved by the alleged illegal construction being raised by respondent No.6, who is the neighbour of the petitioner, and the inaction of respondent Nos.2 to 5 in this regard, the petitioner filed this Writ Petition.
This Writ Petition came up for admission and hearing on 23-12-2015. At the request of the learned Standing Counsel for Greater Hyderabad Municipal Corporation (GHMC), the case has been adjourned to today. Today, at the hearing, Mr.N.Rishi Kumar, learned Counsel representing Mr.N.Ashok Kumar, learned Standing Counsel for GHMC, on instructions, submitted that even before the petitioner's representation was received by respondent Nos.2 to 5, a notice under Section 452
(1) of the Greater Hyderabad Municipal Corporation Act, 1955 (for short 'the Act'), was issued to respondent No.6, on 05.12.2015, and an order under Section 452 (2) of the Act was passed on 14.12.2015. He has further submitted that a final notice under Section 636 of Act is in the process of being issued and that further action in pursuance thereof will be taken in accordance with law. In the light of the above submissions of the learned Standing Counsel representing respondent Nos.2 to 5, the Writ Petition is disposed of with the direction to the said respondents to inform their further course of action regarding the alleged illegal construction of respondent No.6 to the petitioner
within three weeks from the date of receipt of this order.
As a sequel to disposal of the Writ Petition, WPMP.No.53861 of 2015, filed by the petitioner for interim relief, is disposed of as infructous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 28th December, 2015 LUR
