THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4863 OF 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused under Section 482 Cr.P.C., seeking to quash the proceedings against him in Crime No.148 of 2016 on the file of Ramachandrapuram Police Station, Medak District, registered for the offence punishable under Sections 418, 420, 406 and 464 IPC.

Heard and perused the material available on record. It is alleged that while working as M.R.O in the year 2002, the petitioner issued assignment patta certificates in favour of four persons under political sufferers quota with the file number, which was originally allotted for issuance of income certificate. It is further alleged that the petitioner issued fake patta certificates in respect of Survey No.191 of Kollur vilalge after his retirement with a malafide intention and cheated the Government.

Learned Counsel for the petitioner submitted that the petitioner is aged about 72 years and he retired from service and that omnibus allegations were made against him.

Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to interfere with the investigation in the above crime. However, as the petitioner is aged about 72 years, the 2nd respondent-police are directed to complete the investigation and file a final report, if any, in accordance with law, without arresting the petitioner. In the event of necessity, the 2nd respondent-police are directed to issue a notice to the petitioner for the purpose of investigation. On issuance of such notice, the petitioner is directed to appear before the investigating officer and give an undertaking as to his future appearance as and when required by the investigating agency for the purpose of investigation.
