THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.R.C.No.326 of 2016 ORDER :

The petitioners preferred the present Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved by the docket order dated 22-01-2016 passed in Crl.A.No.174 of 2014 by the II Additional District & Sessions Judge, Adoni, Kurnool District, whereby and whereunder the learned lower appellate court dismissed the appeal for default for non-appearance of appellants.

Having heard the learned counsel for revision petitioners and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that one more chance can be given to revision petitioners to make their submissions before the Court below. Considering the facts and circumstances of the case, petitioners are directed to file petition to restore the appeal and on such filing of the petition, the lower appellate Court is directed to restore the criminal appeal and dispose of the same in accordance with law, as expeditiously as possible, more preferably within a period of three months from the date of receipt of a copy of the order and petitioners herein are directed to appear before the lower appellate Court on all hearing days.

Accordingly, the Criminal Revision Case is disposed of. Consequently, Miscellaneous Petitions pending, if any, shall stand closed.
