THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.23901 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the inaction on the part of the unofficial respondents in taking action against respondent No.5, who is running a school unauthorizedly in premises No.10-4-A/324, Addagutta, Secunderabad, as illegal and arbitrary. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Education appearing for respondents 1 to 4. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not going into the merits of the case, there is no necessity to issue notice to R-5. Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer, seeking a direction to respondents-authorities to consider the representation dated 06.05.2017 submitted by the petitioner with regard to establishment of school by R-5, which according to the petitioner is illegal and unauthorized.

The learned GP would submit that a suitable direction may be given to the authorities to dispose of the representation submitted by the petitioner, if not already disposed of, in accordance with law. Having regard to the above, the Writ Petition is disposed of directing the respondents-authorities to deal with the representation dated 06.05.2017 submitted by the petitioner and pass appropriate orders thereon, in accordance with law, as early as possible,

preferably within a period of four to six weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
