HON'BLE SMT. JUSTICE LALITHA KANNEGANTI WRIT PETITION No.29296 of 2022 O R D E R:
This writ petition is filed questioning the action of respondents in not taking any action on the representation dated 30.06.2022 of the petitioner with regard to the illegal construction carried by the respondent Nos.4 and 5 by encroaching 60ft road leading from Teegalaguttapally to Pallampahad which was laid in front of petitioner's residential Plot No.104 admeasuring 200sq.yards in Sy.No.238/E situated at Teegalaguttapally Village, Karimnagar Municipal corporation limits without valid permission from the respondent No.2 instead of constructing the building in Plot No.101 belongs to the 4th respondent, as illegal and arbitrary.

Mr. S. Ravinder Reddy, learned counsel for the petitioner submits that the petitioner has given representations to the respondent corporation on 30.06.2022 to take appropriate action on the illegal construction made by the unofficial respondents. He submits that no action has been initiated by the respondents. Hence, the petitioner has come up before this court. 3.
Mr. V. Satyam Reddy, learned standing counsel on written instructions submits that on enquiry, they came to known that the respondent No.4 is proceeding with construction and he has obtained the permission. It is stated that the permission was
W.P.No.29296 of 2022 obtained in the year 2019 which is valid for a period of two years. According to the learned standing counsel, the said period has elapsed and earlier, at that point of time, the premises where the permission was granted comes under grampanchayat and now, it is merged with the municipality. He submits that they will take appropriate action and pass appropriate orders on the representation of the petitioner.

Recording the submission of the learned standing counsel, this writ petition is disposed of directing the respondents to issue a notice to the unofficial respondent before passing orders. No order as to costs.
Miscellaneous petitions, if any pending in this writ petition shall stand closed.
