THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7996 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in S.C.No.585 of 2023 on the file of I Additional Metropolitan Sessions Judge, Hyderabad, registered for the offence under Section 302 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The petitioner was charge sheeted for the offence under Section 302 of IPC. It is alleged that this petitioner is the first wife's son of one K.Ashok, who is L.W.2 in the charge sheet. He married L.W.1. L.W.1 also had a son. This petitioner started staying in the upper floor where L.W.1 and L.W.2 were staying. L.W.1 and L.W.2 also had a son. It is alleged that with a motive to get all the property, so that nothing can be given to the deceased

who is the step brother, the petitioner committed murder of the deceased by taking him to a place at Old Malakpet, behind Subbaiah Hotel and cut his throat with a paper cutting blade.

As seen from the charge sheet, all the evidences are circumstantial in nature. There are no eye-witnesses to the incident. However, since charge sheet is already filed, this Court deems it appropriate to grant the relief of bail to the petitioner, subject to following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of I Additional Metropolitan Sessions Judge, Hyderabad.

ii) The petitioner/Accused after release shall appear before the concerned Court on every date of hearing.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
