This appeal is filed by the second respondent-Insurance Company under Section 173 of the Motor Vehicles Act, challenging the judgment and award dated 17.12.2009 passed in M.V.O.P. No.484 of 2008 on the file of the Chairman, Motor Accidents Claims Tribunal-cum-IX Additional District Judge (Fast Track Court), Guntur.

At the time of hearing, learned counsel for the appellant seeks permission of the court to permit the appellant to withdraw the appeal. A letter to that effect was also addressed to the Registrar (Judicial). Permission is granted. 3.

Accordingly, the appeal is dismissed as withdrawn.

Miscellaneous petitions, if any, pending in this appeal shall stand closed.
