THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.35392 of 2015 ORDER:
The grievance of the petitioner was that the Station House Officer, Sirivella Police Station, Kurnool District, the 3rd respondent, and the Tahsildar, Sirivella Mandal, Kurnool District, the 4th respondent, were interfering in his agricultural activities and more particularly the harvesting/cutting of 35 Teakwood trees existing in his patta land in Survey No.548 of Sirivella Village and Mandal, Kurnool District. According to the petitioner, the Divisional Forest Officer, Wildlife Division, Nandyal, issued proceedings dated 14.09.2015 granting him permission to cut down the said 35 Teakwood trees. The Sub-Inspector of Police, Sirivella Police Station, Kurnool District, furnished written instructions dated 12.11.
2015 to the office of the learned Government Pleader for Home, wherein he stated that he had not received any complaint against the petitioner and never interfered in his agricultural activities. In the light of the permission granted by the forest authorities, it is not open to the other departmental authorities to interfere with the cutting of the trees by the petitioner pursuant thereto. It is also to be noticed that the Tahsildar, Sirivella, under proceedings dated 19.02.2014, referred to in the proceedings dated 14.09.2015 of the Divisional Forest Officer, Wildlife Division, Nandyal, seems to have already dealt with the matter at his level. It is therefore unnecessary for this Court to invite counteraffidavits from the respondent authorities or adjudicate the matter on merits. The writ petition is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
