THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41462 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to call for the records in Crime No.196 of 2016 and to quash the same.

Heard and perused the material available on record. The case of the petitioners is that the 4th respondent lodged a complaint against the petitioners, which was registered by the 3rd respondent as Crime No.196 of 2016 for the offences under Section 420 read with 34 IPC and Sections 3, 4 and 76 of the Chit Fund Act, alleging that A-1 & A-2 used to conduct chits and she subscribed two chits, lifted the same, for which A-1 & A-2 obtained blank promissory notes, cheques and that A-1 & A-2 handed over the cheque to the 1st petitioner and basing on the said cheque, the 1st petitioner got issued a legal notice to the 4th respondent demanding her to pay Rs.4,00,000/-. The main grievance of the petitioners is that the 4th respondent has filed a false complaint in order to harass the petitioners only to evade repayment of legally enforceable debt.

Considering the grievance of the petitioners, the 3rd respondent is directed to complete the investigation in Crime No.196 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to report before the 3rd respondent daily between 10.00 a.m. and 5.00 p.m. for a period of ten (10) days.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 30th November, 2016 KL
