HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.258 OF 2017 ORDER:
The present petition is filed under Section 482 Cr.P.C. by the sole accused at the stage requesting the Court to quash the FIR in Crime No.504 of 2016 of Police Station, Sanath Nagar, Hyderabad. The offences alleged against the petitioner are punishable under Sections 506 and 509 of IPC.
Heard Sri P.Srinivas, learned counsel for the petitioner and the learned Additional Public Prosecutor, for the state of Telangana.
So far as the petitioner is concerned, it is the submission of the learned counsel that ex facie looking at the complaint, no offence is made out and the petitioner is pursuing III year engineering course and it is nothing but harassing the petitioner and in fact, niece of the de facto complainant who is the second respondent herein is a major and the petitioner is also major and there cannot be any grievance to the de facto complainant herein and thus pleads innocence and false implication of the petitioner. The learned Additional Public Prosecutor would resist the request.
The crux of the complaint averments would clearly make out prima facie material being present as to the petitioner along with another peeping at the house of the de facto complaint at the relevant time on the date of alleged offence and creating nuisance calling the sister of the de facto complainant, and thus, it cannot
be said that the complaint is bereft of any material to make out prima facie allegations against the petitioner having been committed the offences levelled therein.
Hence, the present Criminal Petition is dismissed.
Miscellaneous applications, if any pending in this criminal petition, stand closed.
