HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19286 OF 2018 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the respondents 4 to 7 in calling the petitioner to the police station and making him to sit for hours together without there being any complaint or case registered against him, as illegal and arbitrary.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions of all the respondents, wherein the 4th respondent stated that a case in crime No.120/2017 dated 15.04.2017 was registered against the petitioner and investigation has been taken up; that the case was charge sheeted on 20.04.2017 vide CC.No.17/2018 before the Judicial First Class Magistrate, Prohibition & Excise, Guntur. It is stated in the instructions of the 5th respondent that a case in Crime No.207/2016 was registered against the petitioner and a charge sheet has been filed vide C.C.No.72/2017. In the instructions of the 6th respondents it is stated that as the petitioner is the key person in selling away the unavailable sites, he was added as accused in Crime Nos.861/2015 and 862/2015 for the offences under Section 420 IPC. It is stated in the instructions of the 7th respondent that cases in Crime No.323/2015 and 559/2015 were registered against the petitioner;

that in Crime

No.323/2015 investigation is completed and charge sheet has been filed vide C.C.No.561/2017 and Crime No.559/2015 is still under investigation. All the respondents stated that they have never threatened or interfered with the life and liberty of the petitioner.

Recording the aforesaid submission of the learned Assistant Government Pleader, the writ petition is disposed of. However, it goes without saying that the respondent police cannot call the petitioner to the police station, except in accordance with law. No order as to costs.
