O R D E R
This Criminal Petition is filed under Section 480 and 483 of BNSS seeking grant of bail to the petitioner, who is arrayed as an accused in P.R.C. No.166 of 2025 arising out of FIR No.408 of 2024 on the file of Saidabad Police Station. 2.
The petitioner herein failed to appear before the trial Court. Consequently, the trial Court issued a Non-Bailable Warrant (NBW) against the petitioner and remanded him to
- 2 - judicial custody on 10.06.2026. The petitioner filed an application before the trial Court seeking recall of NBW. However, the said application was dismissed by the trial Court and remanded the petitioner to judicial custody. 3.
Heard Sri Jarupula Raju, learned counsel for petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner was remanded to judicial custody on 10.06.2026 pursuant to the execution of NBW and that the petitioner could not attend the proceedings before the trial Court as he was unaware of the adjourned dates and consequently, the NBW was issued against him. He further submitted that though the petitioner filed an application for recall of the NBW, the same was dismissed and he was remanded to judicial custody. He further contended that the petitioner is innocent of the allegations levelled against him and had been regularly attending the Court on earlier occasions. He also submitted that the petitioner's wife is in an advanced stage of pregnancy and his presence is required to take care of her. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the petition, contending that the petitioner failed to appear before the trial Court without any justifiable cause, thereby delaying the proceedings. He further submitted that the trial Court has rightly dismissed the application and remanded the petitioner to judicial custody and that if the petitioner is enlarged on bail, the petitioner may again fail to appear before the trial Court. Hence, prayed the Court to dismiss the criminal petition.

Having considered the rival submissions and upon perusal of the material available on record, it is evident that the petitioner has been in judicial custody since 10.06.2026. The record further discloses that the case is presently at the stage of P.R.C. and therefore, the trial is not likely to conclude in the near future. Taking into account the overall facts and circumstances of the case, the stage of the proceedings, the period of incarceration undergone by the petitioner and without expressing any opinion on the merits of the case, this Court is of the considered opinion that the petitioner is entitled to be enlarged on bail, subject to the following conditions:

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Sessions Court, Nampally at Hyderabad.
ii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).
iii.
The petitioner shall cooperate with the trial by appearing before the trial Court on each and every adjournment till the conclusion of the trial. 7.
