Petitioner is working as Lamp Fitter in the respondent - Company. He claims to be suffering with cardiac problem. He sought examination by the Chief Medical Officer of the respondent - Company, the 4th respondent, and also requested to refer him to Care Hospital for examination on his health problems. It appears, the petitioner was referred to Care Hospital and based on its report, he was advised to apply to Corporate Medical Board of the respondent - Company through proper channel. It appears, the petitioner without submitting such application filed this Writ Petition.

Learned counsel for the petitioner sought to contend that a request was made by the petitioner through online portal, but the same was not accepted and therefore the petitioner could not apply.

However, there is no averment in the affidavit with regard to his request through online portal. From a reading of the proceedings, dated 13.02.2017, it is clear that the petitioner was advised to apply for Corporate Medical Board through proper channel. Therefore, the petitioner ought to have submitted a representation to the Unit Head, where he is working, and he can have grievance, if only the authority concerned does not forward his request or though attempt made by him through online portal but was not accepted. The petitioner straight away rushed to this Court challenging the proceedings dated 13.02.2017.

Having regard to these facts, this Court is not inclined to entertain the Writ Petition and keep the same pending. 5.

The Writ Petition is accordingly disposed of granting liberty to the petitioner to comply with the advice given by the respondent - Company in the impugned proceedings, dated 13.02.2017. It is needles to observe that as and when such request is made to the Unit Head, the same shall be processed and appropriate decision be taken, and such decision shall be communicated to the petitioner by a reasoned order. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
