O R D E R
As per the averments made in the affidavit filed in support of the writ petition, petitioner is running a scanning centre in the name and style of "Naveen Scan Centre", by obtaining necessary certificates and permissions from the competent authority under Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection), Act, 1994, and conducting the scanning centre since 2008. While so, on 26.4.2018, the National Inspection and Monitoring Committee (NIMC) and State team as well as District Level Multi Member team, the appropriate authorities under the said Act, inspected the premises of the petitioner and seized the scanning equipments and other records, alleging certain lapses. Petitioner was issued with show-cause notice dated 27.04.2018 and he submitted his explanation on 3.5.2018.
The grievance of the petitioner is that without considering his explanation, respondents 3 and 4 passed order dated 17.05.2018 suspending the registration of the scanning centre, and he preferred appeal to the 2nd respondent on 06.06.2018. Aggrieved by the inaction of the 2nd respondent in passing interim order for release of seized machinery of the petitioner and in disposing of the appeal, the present writ petition has been filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Medical and Health.
In view of the above facts and circumstances, writ petition is disposed of directing the 2nd respondent to dispose of the appeal filed by the petitioner in according with law, after affording the petitioner an opportunity of being heard, within a period of two weeks from the date of receipt of a copy of this order.
