HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.12953 of 2007 ORDER:

Heard counsel for the petitioner as well as the respondents.

The present writ petition is filed seeking a direction to respondent Nos.1 and 2 to impound the passport of the 4th respondent vide passport No.111808704 as per Section 10(3)(a) and (e) of the Passports Act, 1967 (for short, "the Act") and the Rules framed thereunder and to expedite the investigation in Crime No.129 of 2007.

During the course of hearing, it is brought to the notice of the Court that after investigation a charge sheet was filed and the Court concerned has taken cognizance of the same and numbered as C.C.No.4560 of 2008. During the course of trial, as accused Nos.1 and 4 to 6 were absconding, the case was split up and the trial was conducted against accused Nos.2 and 3. After full-fledged trial, the Court below has acquitted accused Nos.2 and 3.

Though time has been granted to the respondents to get the information on the arrest of accused Nos.1 and 4 to 6 and whether trial is conducted or not, there is no information from the 3rd respondent. Simultaneously, there is no information from respondent Nos.1 and 2 as to any action is taken or not in compliance with Section 10(3)(a) and (e) of the Act. In these circumstances, respondent Nos.1 and 2 are

directed to take action against the 4th respondent for impounding his passport bearing No.111808704 in compliance with the provisions of Section 10(3)(a) and (e) of the Act, if not already impounded, since the criminal case is already pending against him.

With the above observation, the writ petition is disposed of.

Miscellaneous petitions, if any, shall also stand dismissed.
