HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.20045 OF 2018 ORDER: (ORAL) (per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioners seek direction thereby to declare the action of the respondents for not regularize the services of the petitioners, as illegal, arbitrary, discriminatory, void, violative of the Rules issued by the Government from time to time and also violative of the Article 14, 16, 21 and 226 of the Constitution of India and consequently directing regularization of services of the petitioners with effect from 05.06.1994 notionally, with all consequential benefits and attendant benefits, by setting aside the judgment dated 31.05.2018 passed in O.A No.547 of 2018 by the Andhra Pradesh Administrative Tribunal, Hyderabad.

Learned Government Pleader for Services (AP) appearing on behalf of respondents No.1 to 3, and learned counsel appearing on behalf of the respondent No.4, submit that, the similar issue came before the Supreme Court in case of B.SRINIVASULU Vs NELLORE MUNICIPAL CORPORATION1. This Court in W.P No.33936 of 2011 and batch vide relying upon B.SRINIVASULU's case (supra) 1 Civil Appeal No.6318 of 2015 decided on 17.08.2015
directed the respondents to consider the case of the petitioners.
3. The aforesaid submissions made by learned Government Pleader and Learned counsel have not been disputed by the learned counsel for the petitioners and submits that the issue is covered by B.SRINIVASULU's case (supra).
4. Accordingly, we hereby direct the respondents to consider the case of the petitioners and pass orders within four (04) weeks from the date of the receipt of a copy of this order.
5. In view of the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any pending, shall stand closed.
