THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO CIVIL REVISION PETITION No.3890 OF 2014 ORDER:

This Revision is filed under Article 227 of the Constitution of India challenging the order dated 08.10.2014 in O.S.No.545 of 2008 of the Principal Junior Civil Judge, Proddatur, YSR Kadapa District refusing to allow the petitioner/plaintiff to mark a document dated 07.02.2002.

The Court below considered the recitals in the document and held that the said document limits the right of Yerragudi Hussainamma in respect of houses bearing D. Nos.10/680-A and 10/680-B and therefore under Section 17 (b) of the Registration Act, 1908 the said document requires registration and since it is unregistered, it is inadmissible in evidence. Learned counsel for the petitioner has produced the said document and after perusing the recitals therein, I am of the opinion that the view of the Court below appears to be correct and that the document in question requires registration. Therefore, I do not find any merit in the Revision.

The Civil Revision Petition is accordingly dismissed. There shall be no order as to costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
