M.Sanjay Reddy v. Kanumuri Narayana Raju
THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Civil Revision Petition No.4324 of 2011 ORDER:
This civil revision petition under Article 227 of the Constitution of India by the unsuccessful appellant/plaintiff is directed against the orders dated 08.11.2010 of the learned I Additional District Judge, Ranga Reddy passed in CMA.no.610 of 2009 whereby the learned Additional District Judge while dismissing the said appeal had confirmed the orders dated 22.08.2008 of the learned VII Additional Senior Civil Judge, Ranga Reddy passed in IA.no.767 of 2008 in OS.no.62 of 2007 filed by the plaintiff under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, 1908 for a temporary injunction restraining the defendants from alienating the suit schedule property to third parties.
2. When the revision is taken up for hearing today, the learned counsel for the revision petitioner would submit that he has no instructions from the revision petitioner.
3. This Court, while ordering notice before admission on 14.10.2011, had granted interim stay of the execution of the judgment and decree of the lower appellate Court for a period of eight (08) weeks from that day. From the note of the Registry it appears that the suit itself was disposed of on 14.06.2012. Therefore, no cause survives for adjudication in this revision.
4. Accordingly, the Civil Revision Petition is dismissed as infructuous. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this revision shall stand closed.
