THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6253 of 2022 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/A1 to A5 seeking bail in the event of their arrest in connection with Crime No.271/2022 on the file of Subedari Police Station, Warangal District, registered for the offences punishable under Sections 143, 506, 307, 448, 380, 427 read with 149 of Indian Penal Code.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that a complaint is lodged against these petitioners alleging that A5 is the wife of defacto complainant's brother and there were differences regarding marriage. On 21.05.2022 these petitioners along with 10 others trespassed into the house of the injured and cut the left hand of the injured with knife. Further, all the accused committed theft of several documents i.e. FD bonds, chit bonds, promissory notes, Aadhar cards, will deed, pension bond papers, bank pass books, ATM cards etc. and left. Aggrieved by the same, present complaint was filed.

Learned Counsel for the petitioners submits that the injured married thrice; that before marrying Accused No.5 he got married once and after marrying A5, he again married another woman; and that for the said reason there were disputes amongst the family members.

On the other hand learned counsel appearing for the impleaded respondent/defacto complainant submits that there is every chance of the victim being killed by these petitioners if they are released on Anticipatory Bail.

As seen from the allegations, 15 members attacked the victim and others in his house on 21.05.2022 and committed theft of several important documents and papers which description is given in the complaint. However, keeping in view the family disputes regarding the marital differences, these petitioners can be granted the relief of Anticipatory Bail.

Accordingly, the criminal petition is allowed and the petitioners/A1 to A5 shall be enlarged on bail in the event of their arrest, subject to the following conditions:
1) The petitioners/A1 to A5 are directed to surrender before the Station House Officer, Subedari Police Station, Warangal District, on 25.07.2022. On such surrender, the said Station House Officer shall release
the petitioners/A1 to A5 on bail, on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties in a like sum each to his satisfaction.
2) On such release, the petitioners/A1 to A5 shall continue to appear before the police every day for a period of two weeks at 9.00 a.m. to 1.00 p.m. and thereafter every Monday for a period of eight weeks, for the purpose of investigation.
3) The petitioners/A1 to A5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
