THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18955 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of the third respondent in harassing the petitioner and sending constables to the house of the petitioner, without any case being pending against the petitioner, as illegal and arbitrary.

Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. Learned counsel for the petitioner mainly submits that without any case being pending against the petitioner, the third respondent is sending constables to the house of the petitioner and thereby interfering with the personal life and liberty of the petitioner.

Learned Assistant Government Pleader denies the allegations made in the affidavit filed in support of the Writ Petition and submits that the allegation of petitioner being summoned to Police Station is incorrect. She further submits that if any action is sought to be taken by the respondents, the same would be in accordance with the procedure established under law. Having regard to the above, the Writ Petition is disposed of directing the respondents-Police not to interfere with the personal life and liberty of the petitioner without following due process of law.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
