THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.29281 of 2017 ORDER:

The proceedings of the Deputy Commissioner of Prohibition and Excise, Ranga Reddy Region vide Cr.No.B2/877/2017/DCRR, dated 29.06.2017 and Cr.No.B2/877/2017/DCRR, dated 26.07.2017, are under challenge in the present writ petition.

When the matter is taken up, learned counsel for the petitioner placed on record the order passed by the Hon'ble Apex Court in SLP (Civil) No.10243 of 2017, dated 11.07.2017. In the said order, the Hon'ble Apex Court clarified that the order passed earlier does not prohibit the licensed establishments within municipal areas. On noticing the same, a suggestion is made by the learned Government Pleader that the petitioner can make a representation before the Commissioner of Prohibition and Excise, 2nd respondent herein, by enclosing a copy of the order of the Hon'ble Apex Court, and if any such representation is made, the same will be considered in accordance with law.

Recording the said submission, this writ petition is disposed of, keeping it open for the petitioner to make a representation before the 2nd respondent by enclosing a copy of the order of the Hon'ble Apex Court referred to supra, within a period of two weeks from the date of receipt of this

order. On receipt of such representation, the 2nd respondent shall consider the same and pass appropriate orders in accordance with law, within a period of four weeks thereafter. No order as to costs.

Miscellaneous petitions, if any, shall also stand disposed of.
