THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Criminal Petition No.2804 of 2011 ORDER:

This criminal petition, under Section 482 of the Code of Criminal Procedure, 1973 ('the Code', for brevity) is filed by the petitioner-accused requesting to quash the proceedings in Crime No.29 of 2011 of Chilakalapudi Police Station, Krishna District.

At the hearing, it is submitted that after completion of investigation, a charge sheet/ final report has already been filed. A perusal of the order, dated 30.04.2011, of this Court would show that on that day the learned counsel for the petitioner submitted before this Court that there was an interim order of stay granted on 29.03.2011 in Crl.MP.No.2941 of 2011 and that the said stay orders are covering the period of investigation also and that despite the said orders being in force, investigation was completed and a charge sheet/ final report was filed. This Court noted that there was a dispute as to whether the stay orders are served on the police concerned or not. Be that as it may.

In view of the fact that a charge sheet has already been filed, this Court is of the considered view that no cause survives for adjudication in this criminal petition.
