THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.9228 of 2007 ORDER:

This writ petition is filed seeking to continue the services of the petitioner up to the age of 60 years.

While admitting the writ petition, this court granted interim direction to the respondents to continue the services of the petitioner until further orders.

It is submitted by both the counsel that pursuant to the interim orders granted by this court, the services of the petitioner was continued till he attained the age of 60 years. In that view of the matter, the relief claimed in the writ petition has worked out. However, the learned counsel for the petitioner submits that inasmuch as the petitioner continued up to the age of 60 years, the retirement benefits as applicable may be directed to be paid.

Since the main relief as claimed in the writ petition was already granted, in so far as the retirements benefits are concerned, it shall be open for the petitioner to approach the respondent authorities by making a representation. As and when such a representation is made, the same shall be considered and appropriate orders be passed thereon, in accordance with law.

Accordingly, the Writ Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in consequence.
