VRS, J & AKS, J WP No.33188 of 2017 HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.33188 OF 2017 ORDER: (per V. Ramasubramanian, J) The petitioner, who was allotted a seat in M.Ch. Thoracic Surgery for the academic year 2017-18 in the 3rd respondent College, opted to refuse the allotment and take back his original certificates. But, the 3rd respondent wanted to wait for instructions from the 1st respondent. Since time for joining another college was running out, the petitioner came up with the above writ petition seeking appropriate directions.

2. On 09.10.2017, we directed the Assistant Solicitor General to take notice for the 1st respondent and directed the petitioner to take personal notice to the 3rd respondent returnable by 23.10.2017. In the meantime, we also passed an interim order directing the 3rd respondent to release the certificates, without waiting for directions from the 1st respondent.

3. Pursuant to the said order, notice has been served on the 3rd respondent.

4. Today Mr.K.V. Simhadri, learned counsel for the petitioner produced a copy of the proceedings of the Principal of the 3rd respondent College bearing No.B3/ 18257/ 2017/ MCC dated 17.10.2017. The contents of the proceedings read as follows: " Dr. PAILLA RAMBABU who has been admitted on 31.08.2017 for M.Ch. Thoracic Surgery - 2017 through All India quota has requested to relieve him from the college. Therefore he is relieved from this college with effect from 17.10.2017. the original certificates submitted by him at the time of admission are also returned herewith.

The amount of Rs.49,900/ - (Rupees Forty-Nine Thousand Nine Hundred) deposited by him at the time of admission is hereby released and will be refunded from the PD Account-I of the Principal Government Medical College, Kozhikode."

5. In view of the above, nothing survives for adjudication in the writ petition. Hence, the writ petition is closed.
