HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRL.P.No.2119 OF 2017 ORDER:

This criminal petition is filed under Section 438 of Cr.P.C to enlarge the petitioner on bail in the event of his arrest in connection with Crime No.256 of 2016 of CCS Police Station, Hyderabad, registered for the offences punishable under Sections 420, 406 and 506 of IPC read with 120-B of IPC.

After arguing the matter for some time, learned counsel for the petitioner requested this Court to permit the petitioner to surrender before the Magistrate concerned and on such surrender, if any application is filed for grant of bail, the Magistrate concerned may be directed to decide the said application on the same day.

In view of the request made by the learned counsel for the petitioner, without touching the merits of the case, I deem it appropriate to permit the petitioner to surrender before the Magistrate concerned, if any application is filed to enlarge him on bail after serving notice on respondent, the Magistrate concerned is requested to decide the application filed by the petitioner on the same day. With the above observation, this criminal petition is disposed of. Pending miscellaneous petitions in the petition, if any, shall stand closed.
