THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.19458 of 2018 ORDER:

Heard learned Counsel for the petitioner and the learned Government Pleader for Industries Commerce for the State of Telangana.

The grievance of the petitioner in the present Writ Petition is that instead of considering the case of the duly elected Managing Committee for appointment of the person-in-charge in terms of G.O.Rt.No.95, Agriculture and Cooperation (Coop.II) Department, dated 10.02.2018, the Assistant Director of Handlooms & Textiles, Mahabubnagar, vide Proc.Rc.No.1203/2015-C, dated 22.07.2018, appointed an Official Person-in-charge.

On the other hand, it is submitted by the learned Government Pleader, on instructions, that in view of certain allegations against the Managing Committee, their case was not considered and the said action is strictly in accordance with G.O.Rt.No.95, dated 10.02.2018.

It is submitted by the learned Counsel that on 23.07.2017, the petitioner herein submitted a representation to the Assistant Director of Handlooms and Textiles for consideration of their case for appointment as Person-in-charge and the same is not replied to so far.

The receipt of the said representation is disputed by the learned Government Pleader and on instructions, it is submitted that no such representation was submitted before the Office of the Assistant Director.

Having regard to the submissions, this Court deems it appropriate to dispose of the Writ Petition, leaving it open for the petitioner herein to make an appropriate application/representation before the respondents for consideration of his case for appointment of the Person-in-charge of the Committee, within a period of two weeks from the date of receipt of a copy of this Order.

If any such application/representation is made to the authority, within the time stipulated above, the respondents shall verify the same and pass appropriate Orders, strictly in accordance with law, within a period of four weeks thereafter.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
