THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.23292 OF 2002 O R D E R:

This writ petition is filed by the petitioner declaring the action of the first respondent contained in the letter No.JA/118(52)/V&SO/VZM-02, dated 07.11.2002 in so far as it relates to the posting of the petitioner to Tuni Depot, East Godavari District in the category of Security Guard as arbitrary, illegal and to direct the respondents to continue the petitioner as Security Guard in Vizianagaram Depot, where he was working prior to the order of suspension dated 31.07.2002 and allow all consequential benefits and grant such other relief as it deems fit in the circumstances of the case.

The learned counsel for the petitioner contends that the petitioner is a Class-IV employee and as such, the respondents are not entitled to transfer him from one region to another region, as it was done in this case. He also submits that as per the transfer policy of the Corporation, Security Guard is liable to be transferred within the Region.

The learned counsel for the respondent Corporation states that as per the relevant guidelines, the respondent authorities are entitled to transfer the employees from one region to another region. By order, dated 21.11.2002, this Court in W.P.M.P.No.29207 of 2002 granted interim suspension of the impugned order and the same is binding all these years.

In view of the above, it is open for the respondent authorities to follow the relevant guidelines, if they intend to transfer the petitioner.

Accordingly, the writ petition is disposed of. Miscellaneous petitions, if any, pending shall stand closed. No order as to costs. ___________________________ A.RAJASHEKER REDDY, J.
