HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36094 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a direction to the 3rd respondent to register the crime against the 4th respondent.

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that he obtained finance from the 4th respondent for purchasing the vehicle-Tipper and he is paying installments regularly without any default. But the 4th respondent highhandedly took away the vehicle without any intimation to the petitioner. He immediately lodged a complaint before the 3rd respondent on 20.3.2016. But the 3rd respondent has not registered the any crime against the 4th respondent.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

"Respondent No.3 is directed to register the complaint of the petitioner dated 20.3.2016, if it discloses any cognizable offence and proceed in accordance with law. If the above respondent fails to register the complaint, the petitioner is at liberty to approach the higher officials or to avail the remedies that are available under Cr.P.C."

There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
