HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.29388 of 2017 ORDER:

The action of respondent No.3 (Station House Officer, Burgampahad Police Station, Khammam District), in interfering with the possession and enjoyment of the petitioner's land admeasuring Ac.0.01 cent situated at Sarapaka Basappa Camp, Burgampahad Mandal, Khammam District, at the behest of respondent Nos.4 and 5, and threatening not to enter into the said land, is questioned in this Writ Petition as being illegal and arbitrary. Learned Government Pleader for Home (TS), on instructions, would submit that, on the complaint of respondent No.4, respondent No.3 registered a case in Crime No.178 of 2017 on 27.06.2017 under Sections 341, 294(b) and 506 read with 34 IPC against Sri Thirumalareddy Seetharami Reddy and Thirumalareddi Koteswaramma as they restrained respondent No.4 and obstructed pathway by erecting sticks as fencing; during the course of investigation, it was revealed that accused objected and quarreled when respondent No.4 parked his auto in the pathway;

investigation is under progress for collection of evidence; the allegation, that respondent Nos.4 and 5 wanted to grab the subject plot and therefore threatened the petitioner not to enter the subject land, was denied; only to divert the attention of the investigating agency, and as the petitioner bore grudge against respondent Nos.4 and 5, the present writ

petition has been filed; and respondent No.3 neither had interfered nor had threatened the petitioner not to enter the subject land.

Recording the submission of the learned Government Pleader for Home (TS) that respondent No.3 neither had interfered nor had threatened the petitioner not to enter the subject land, the writ petition is closed.
