HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.32024 of 2017 ORDER:
This writ petition is filed to declare the action of the respondents in not releasing and paying the annual grade increments to the petitioner, which were sanctioned earlier in Proceedings No.P1/320(1)99-DSNR, dated 09-10-1993 issued by the Depot Manager, Dilsukhnagar from 2004 onwards as arbitrary and illegal.
Learned counsel for the petitioner submits that the 3rd respondent issued notice by proceedings dated 23-11-2005 stating that the annual grade increments are permissible to those conductors who were appointed on or after 01-01-1980 and before 24-04-1980 but not to the petitioner who was appointed on 13-07-1985 and proposed to withdraw the graduate increments sanctioned to the petitioner. On that the petitioner submitted explanation dated 10-12-2005 to the said show-cause notice. But no order has been passed by the respondent-authorities on the same.
Learned Standing Counsel on instructions submits that they are unable to trace the explanation filed by the petitioner to the show-cause notice dated 23-11-2005.
In view of the same, it is open for the petitioner to submit a copy of explanation to the show-cause notice dated 23-11-2005 with in a period of four weeks from today. On such submission, the 3rd respondent is directed to consider the same and pass orders within a period of six weeks thereafter and take action accordingly. If for any reason, the respondent-authorities are
unable to pass any orders, the 3rd respondent is directed to release the increments.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
