THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.38061 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

"...declaring the inaction of the part of the respondents 1 to 3 in not issuing pattadar passbooks and title deeds in favour of the petitioners 1 to 3, for the agricultural land in S.No.94, admeasuring Ac.0.50 cents, Ac.2.00 cents and Ac.0.90 cents respectively, situated in Annavaram Village, Bheemunipatnam Mandal, Visakhapatnam District is arbitrary, illegal and violative of Article 14 of the Constitution of India and violation of the provisions of the A.P Rights in Land and Pattadar Passbooks Act, 1971...."

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue. With their consent, the writ petition is disposed of at the stage of admission.

Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the 3rd respondent-District Collector, Visakhapatnam to dispose of the representation, dated 14.04.2016, made by the petitioners for cancellation of pattadar passbooks and title deeds in Khatha Nos.998 and 995 to an extent of Ac.14-00 cents and Ac.12-00 cents issued in favour of Sritantala Surya Rao S/o Appanna and Pilli Yella Rao S/o Appa Rao respectively in survey No.94.

Learned Assistant Government Pleader for Revenue would submit that the 3rd respondent will pass orders on the representation of the petitioners, dated 14.04.2016, provided the same is still pending consideration.

Having regard to the facts and circumstances of the case and submission of learned counsel for the petitioners, the Writ Petition is

disposed of directing the 3rd respondent-District Collector, Visakhapatnam, to dispose of the representation, dated 14.04.2016, made by the petitioners seeking cancellation of pattadar passbooks and title deeds in Khatha Nos.998 and 995 for an extent of Ac.14-00 cents and Ac.12-00 cents issued in favour of Sritantala Surya Rao S/o Appanna and Pilli Yella Rao S/o Appa Rao respectively, in accordance with law, as early possible, preferably within a period of four (04) to six (06) weeks from the date of receipt of a copy of this order.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
