HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NOs.21969 & 24518 OF 2000 COMMON ORDER:

Heard Sri Nandigam Krishna Rao, learned Counsel for the petitioners.

Learned Counsel for the petitioners contended that the 1st respondent-bank has many other branches and that the petitioners in both the cases filed the above writ petitions seeking promotion to the post of Middle Management Grade Scale II in the 1st respondent-Bank, on the basis of seniority-cum-merit and that he has no instructions from his clients about their present status in the 1st respondent-Bank and he could not contact them.

Perusal of the cause title in W.P.No.24518 of 2000 reveals that the age of the petitioner therein was 43 years at the time of filing the writ petition, and by afflux of time, he must have retired from service, and no cause survives for adjudication. Insofar as W.P.No.21969 of 2000 is concerned, the cause title reveals that the age of the petitioner therein was 35 years at the time of filing the said writ petition and the cause may survive in W.P.No.21969 of 2000. But the learned Counsel for the petitioners pleads that he has no instructions from his clients and he could not contact them in spite of his best efforts and therefore, both the writ petitions can be closed.

In any event, if any cause survives and if the petitioners are aggrieved by closure of these writ petitions, they may file appropriate applications to restore the writ petitions to be disposed of on merits.

Accordingly, the Writ Petitions are dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
