THE HON'BLE SRI JUSTICE R.SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.31270 OF 2015 ORDER:- (per Hon'ble Sri Justice R.Subhash Reddy) While issuing notice before admission on 23.09.2015, this Court passed an interim order that the sale proposed to be held on 28.09.2015 pursuant to the notice issued under Section 13(4) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 may go on, however, the sale certificate shall not be issued to the highest bidder on condition of the petitioner depositing half of the amount due within a period of two (2) weeks from that day.

2. When the matter was listed for hearing on 08.10.2015, there was no representation on behalf of the petitioner and at the same time, it was represented by the learned Standing Counsel appearing for the respondent Bank that the petitioner has not complied with the conditional order, dated 23.09.2015, of this Court. As there was no representation for the petitioner, the matter was directed to be posted to today under the caption "For dismissal". Today also, when the matter is called, there is no representation for the petitioner. Therefore, the petitioner is not evincing any interest in prosecuting its case.

3. Accordingly, the Writ Petition is dismissed for non-prosecution. There shall be no order as to costs.

4. Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
