THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.25888 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. The petitioner states that the respondents are trying to demolish the three sheds constructed by her in premises bearing Door No.3/119 to an extent of 150 sq. yards in R.S.No.478 of Denduluru Village and Mandal, West Godavari District. The petitioner alleges that no notice is issued to her and no procedure under the Andhra Pradesh Land Encroachment Act, 1905 is also followed, in spite of the directions of the Collector, West Godavari District, the 2nd respondent, in Roc.No.5803/E2/2011, dated 25.10.2011, wherein it is specifically stated that the Tahsildar, Denduluru Mandal, West Godavari Distrct, the 4th respondent, shall follow the procedure prescribed and take further action.

The present Writ Petition is filed alleging that notwithstanding the said order, the respondents have approached the petitioner on 12.08.2015 and asked her to vacate the said premises. In the facts and circumstances of the case, the 3rd and 4th respondents are directed to ensure that the order of the 2nd respondent, referred to above, is complied with and appropriate action, if any required, be taken only after following the due procedure under law.

Subject to the above, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
