Heard learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents. 2.
According to petitioner, he being the landless poor person was assigned land to an extent of Ac.1.30 guntas in Survey No.1421/226 of Ramayampet Village and Mandal, Medak District, vide proceedings dated 12.01.1999 and is in possession and enjoyment of the same. According to learned counsel for the petitioner, assignment was granted to him in the year 1999 and the same is not cancelled. If that being so, recently, attempts are being made to dispossess the petitioner from the subject land and to utilize the said land for the purpose of construction of two bedroom houses.

However, except producing the proceedings of assignment granted to the petitioner and the reflection of his name in the pahanies, no other material is placed on record showing that there is identification of land with clear demarcation and from that land, petitioner is being dispossessed and to use the said land for construction of two bedroom houses.

Since the plea itself is vague and no other material is available on record, the prayer directing the respondents not to interfere with the peaceful possession cannot be granted to the petitioner.

Thus, the Writ Petition is dismissed leaving it open to the petitioner to work out his remedies in accordance with law and if so advised, apply for conducting of survey and demarcation of the subject land, if the same was not already cancelled and assignment proceedings continue in his favour.
