THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CIVIL REVISION PETITION No.5656 OF 2016 ORDER:

This Civil Revision Petition is filed seeking a direction to the learned Additional Senior Civil Judge at Srikakulam to dispose of O.S.No.197 of 2007 as expeditiously as possible. 2.

The contention of the petitioners, who are defendant Nos.8, 9 and 10 in the suit, is that the suit has been filed for partition and the same is pending since nine years without any progress thereby, frustrating the very claim made by the parties before the Court below.

The learned counsel appearing for the petitioners submitted that the reason for the delay is that one of the defendants viz., Dusa Adinarayana died and the application to implead the legal representatives of the said deceased has been filed with incorrect description and address and hence, notice could not be served and therefore, the learned judge is adjourning the suit without there being any progress.

In view of the above submission, the Civil Revision Petition is disposed of and the learned Additional Senior Civil Judge at Srikakulam has to bestow his personal attention into the matter so that substantial progress can be made in O.S.No.197 of 2007 as expeditiously as possible and every endeavour should be made to dispose of the same expeditiously. No costs.
