THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY W.P.No. 40127 OF 2014 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) Both Sri N.Ramesh, learned counsel for the petitioners, and the learned Government Pleader for Medical Health & FW (T.S.) would agree that, as the petitioners herein were given the benefit of notional promotion in the category of Senior Assistant, during the pendency of proceedings in O.A.No. 5160 of 2011 before the Andhra Pradesh Administrative Tribunal at Hyderabad ("Tribunal" for short), vide proceedings dated 30-06-2012, the cause in O.A.No. 5160 of 2011 became infructuous thereafter; and it is only on account of the petitioners' failure to bring to the notice of the Tribunal, the aforesaid proceedings dated 30-06-2012, was the O.A.

dismissed on the basis of the counter affidavit filed by the respondents prior to issuance of these proceedings. The order of the Tribunal is, therefore, set aside. The Writ Petition is disposed of accordingly. Pending miscellaneous petitions, if any, in this Writ Petition shall stand closed in consequence. No order as to costs.
