THE HON'BLE SRI JUSTICE A.VENI{ATESHWARA REDDY CIVIL REVISION PETITION No.2375 OF 2OL9 ORDER:
Heard learned counsel for the revision petitioner. Though the respondents are represented by Sri Bandi Sai Vamsi and Sri E.Venkata Reddy, none appeared on call. Perused the record. 2.
This Civil Revision Petition is fited under Article 227 of Constitution of India for a direction to the learned Junior Civil Judge at Alair to take up the Election O.P. No.2 of 2019, filed by the petitioner on priority basis and to decide the same within a time frame.
3.
Main averments in the grounds of CRP are that the petitioner contested the election and lost with a margin of 15 votes; there were lot of irregutarities in the counting, and that the l"t respondent is elected and enjoying the position of Sarpanch of the village whereas, the Court is generously granting adjournments defeating the very purpose of Iiling O.P. No.2 of 2019. 4.
Having regard to the averments in the grounds of memorandum of revision and also in view of the fact that there is
no representation on behalf of the respondents on call, as the learned counsel for the petitioner 1S seeking for expeditious disposal of the matter, I find some justification to allow this petition.
5. In the result, this CRP is allowed, learned Junior Civil Judge at Alair is hereby directed to make every endeavor-rr for disposal of Election O.P.No.2 of 2019, pending on the Iile of that Court within a period of nine months from the date of receipt of copy of order irrespective of the fact that whether the parties cooperate for expeditious disposal or not. Both the parties to the Election O.P. No.2 of 2Ol9 shall co-operate with the trial Court for expeditious disposal, as directed. In the circumstances of the case, the parties shall bear their respective costs. Miscellaneous petitions, if any, pending, in this CRP, shall stand closed.
