Learned Assistant Government Pleader for Arbitration submits that the EP amount which was directed to be paid by the Court below in EP No.33 of 2006 in OS No.24 of 2003 has been paid to the respondent-decree holder and this civil revision petition filed by the Government against the order passed in EP No.33 of 2006 has become infructuous and no further orders are necessary. It is also stated that the appeal AS No.426 of 2006 filed by the Government against the judgement and decree passed in OS No.24 of 2003 has also been dismissed by this Court.

2. In view of the above circumstances, nothing survives for adjudication in this revision petition and it is accordingly dismissed.
