THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5914 of 2017 ORDER:

This Writ Petition is filed challenging the action of respondent Nos.3 and 4 in issuing notice under Section 41 of the Code of Criminal Procedure to the petitioners in connection with Crime No.26 of 2017 registered on the complaint of the fifth respondent.

The allegation of the petitioners is that there are civil disputes pending between the sixth respondent and the petitioners and in that connection a civil suit was also filed. However, on the complaint of the fifth respondent, the crime was registered by the Police and in the said process the Police are harassing the petitioners.

It is needless to observe that Police shall investigate the crime only in accordance with law by duly following the provisions of the Code of Criminal Procedure and not harass the petitioners.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 21.02.2017 vs
